These Terms of Service ("Terms") govern your use of the Mavyn website, products, and services (collectively, the "Service"). Mavyn ("we," "us," or "our") operates at trymavyn.com.

By visiting our Site, purchasing our products, or using any part of our Service, you agree to be bound by these Terms. Please read them carefully. If you do not agree to these Terms, you may not access the Site or purchase our products.

We reserve the right to update or modify these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the new Terms. The most current version will always be available on this page.

Our store is hosted by Shopify Inc., which provides us with the e-commerce platform that allows us to sell our products to you.

SECTION 1 - ELIGIBILITY & ACCOUNT RESPONSIBILITY

By agreeing to these Terms, you represent that:

• If purchasing for a minor, you are the parent or legal guardian with authority to purchase dietary supplements for that minor

Mavyn Kids Methylfolate is a dietary supplement intended to support nutritional needs. Our products:

• Have not been evaluated by the Food and Drug Administration
• Should not replace medical advice or treatment
• Are intended for children ages 1-18 under parental supervision

You agree to:
• Consult a healthcare provider before giving Mavyn to your child, especially if they have a medical condition or take medications
• Read and follow all label instructions and warnings
• Discontinue use and contact a healthcare provider if adverse reactions occur
• Keep products out of reach of children (adult supervision required for administration)
• Store products as directed on the label

We do not guarantee:
• Specific health outcomes or results
• That the product will be suitable for your child's individual needs
• That the product will work the same for every child

• Refuse or cancel orders at our discretion

If we cancel an order after your payment has been processed, we will issue a full refund to your original payment method.

We may limit sales to specific geographic regions or jurisdictions.

Shipping rates are calculated at checkout based on your delivery address and order weight. You will see the exact shipping cost before completing your purchase.

SECTION 6 - ORDERS & PAYMENT

Order Acceptance:
All orders are subject to acceptance by Mavyn. We reserve the right to refuse or cancel any order for reasons including but not limited to: product unavailability, errors in pricing or product information, suspected fraudulent or unauthorized transactions, or orders that violate these Terms.

Order Modification:
You have 60 minutes after placing an order to modify or cancel it by contacting hellomavyn@gmail.com. After this window, orders are processed for shipment and cannot be modified or canceled. You will need to wait for delivery and follow our return policy.

Payment:
You agree to provide current, complete, and accurate purchase and account information. You must promptly update your account with any changes to your payment information. We accept major credit cards, PayPal, and other payment methods displayed at checkout.

SECTION 7 - SUBSCRIPTION TERMS

Subscription Overview:
If you enroll in a subscription, you authorize Mavyn to automatically charge your payment method at the selected frequency (every 30, 60, or 90 days) until you cancel.

Subscription Terms:
• Subscriptions renew automatically on the renewal date
• You will be charged the then-current subscription price (we will notify you of any price increases)
• Subscriptions receive a discount off the regular retail price
• You can modify or cancel your subscription at any time through your customer portal at trymavyn.com/account or by emailing hellomavyn@gmail.com
• Cancellations must be made at least 24 hours before your next renewal date to avoid being charged
• Canceling an order does not cancel your subscription
• No refunds are provided for subscription charges if you forget to cancel before renewal

Subscription Management:
You are responsible for managing your subscription. We provide easy-to-use tools to: skip a shipment, change delivery frequency, update payment information, and cancel at any time.

SECTION 8 - THIRD-PARTY SERVICES & LINKS

We may provide access to third-party tools or services (e.g., payment processors, review platforms, subscription management). These tools are provided "as is" without warranties of any kind.

Our Site may contain links to third-party websites. We are not responsible for the content, policies, or practices of third-party sites. We recommend reviewing their terms and policies before engaging with them.

SECTION 9 - USER CONTENT & REVIEWS

Some jurisdictions do not allow the limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

You agree to indemnify, defend, and hold harmless Mavyn, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your violation of any rights of a third party
• Your User Content
• Any misuse of the products or failure to follow label instructions

SECTION 15 - DISPUTE RESOLUTION & MANDATORY ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Mandatory Arbitration:
You agree that any claim or dispute arising out of or relating to these Terms, your use of the Service, or any products purchased from Mavyn must be resolved through final and binding confidential arbitration, rather than in court.

You acknowledge and agree that you are waiving:
• The right to a trial by jury
• The right to participate in a class action lawsuit
• The right to certain discovery and appeal rights available in court

Arbitration Procedures:
• Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
• The arbitration will take place in the United States
• You may bring a claim only in your individual capacity, not as a plaintiff or class member in any class or representative proceeding
• The arbitrator's decision will be final and binding
• Judgment on the arbitration award may be entered in any court of competent jurisdiction

Exceptions:
You may assert claims in small claims court if your claims qualify and remain in such court. Either party may seek emergency equitable relief before the arbitration award is rendered.

Opt-Out:
You have the right to opt out of this arbitration agreement by sending written notice to hellomavyn@gmail.com within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.

Survival:
This arbitration provision survives termination of your account or relationship with Mavyn.

SECTION 16 - CLASS ACTION WAIVER

YOU AGREE THAT YOU MAY ONLY BRING CLAIMS AGAINST MAVYN IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

If a court or arbitrator determines that this class action waiver is unenforceable, then the arbitration agreement in Section 15 will be void.

SECTION 17 - GOVERNING LAW & JURISDICTION

These Terms and any disputes arising from them are governed by the laws of the United States, without regard to conflict of law provisions.

Subject to the arbitration agreement in Section 15, you agree to submit to the jurisdiction of courts located in the United States for any actions not subject to arbitration.

SECTION 18 - SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed from these Terms and shall not affect the validity and enforceability of the remaining provisions.

SECTION 19 - TERMINATION

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and Mavyn regarding the Service and supersede all prior agreements and understandings.
